LEASE TO VEST POSSESSION with ASSIGNMENT OF TERM OF YEARS TO ATTEND THE INHERITANCE of messuage and adjoining land of c. 1 acre, 1 rood, in Dunwich, p. All Saints, between kings highway on south and hill called the Mansion View Hill on north [further boundaries given]; plus messuage now wasted with moiety of well between kings highway leading from Church of St Peter to Dearing Bridge on south [further boundaries given]. To 3. at direction of George Downing, in trust for use of 2. to attend inheritance vested in him.
Recites mortgage by demise of 24 June 1707 between Robert Swatman and Nathaniel Copping.
Recites indenture quadripartite of 27 Aug 1709 between 1.Nathanial Copping, 2. Robert Swatman, 3. George Downing and 4. Robert Clarke - that mortgage not repaid interest of Nathaniel became absolute; that Robert Swatman had sold and agreed to convey the said premises to George Downing for £185, and that George Downing had repaid Nathaniel, and therefore Nathaniel, at request of Robert Swatman, and Robert Swatman for consideration mentioned, did bargain, sell and assign the property to Robert Clarke in trust for George Downing to wait upon and attend the inheritance.
And recites indenture of lease and release of even date between 1. George Downing, 2. Robert Buxton of St Southhelmham, Suffolk, Esq.[Helmingham?], and 3. Thomas Bethell the uncle [of which this present is the Lease to Vest possession?]
Endorsed 'Assignment of a term of 1000 years in Robert Swatman's estate from Robert Clarke as trustee for George Downing Esq. to Thomas Bethell, nephew, in trust for Thomas Bethell the uncle, to attend the inheritance vested in him'.
