Articles of Agreement between Sir Thomas Cotton of Connington, Huntingdonshire, and Thomas Cotton of Cotton, Cheshire. Whereas there was an Agreement dated 22 March 1653 that Sir Thomas Cotton should have an absolute estate made to him of the manor of Cotton and Hulme by Thomas Cotton by a certain date and should reconvey the land to Thomas Cotton for life and an annuity to Elline wife of Thomas Cotton for life from the estate, and defalcation to be made for so much as the estate should fall short of the particular; and whereas a certain mill is found to be of less value than the particular, a certain piece of land is found not long to bear the rent at which it was valued, and another parcel of land is agreed to be of a greater value; taking all in all a certain less sum is agreed to be substituted for the original purchase money. Item: an adjustment is made in the purchase money with regard to premises leased for a longer term than was mentioned in the particular. Item: an adjustment is made in the purchase money with regard to certain premises leased under conditions other than those mentioned in the particular and whose yearly value is found to be less than that mentioned. Item: an addition is made to the purchase money with regard to certain premises leased under conditions other than those mentioned in the particular. It is agreed that if further mistakes are found within the term of one year defalcation shall be made in proportion.
