Scope and Contents

Whereas a suit was brought in the Court of Duchy Chamber by Richard Bould of Bold, Widnes, against John Ashton of Penketh to enforce him to grant to Richard Bould all lands late the inheritance of Richard Bould of Bold and to execute the trust reposed in him; and whereas 9 February 1619 it was ordered that John Ashton should convey to Sir Richard Mollyneux the younger of Sephton, Sir Raphe Ashton of Whalley and Thomas Chernock of Astley all such lands as had been sold by Sir Edward Fitton or Sir Thomas Bould of Bold, so that they should be subject to the same trust as John Ashton had been, and that purchasers might exhibit their bills against the feofees; and whereas John Ashton by indenture dated 1 March 1619 conveyed to Sir Richard Mollyneux, Sir Raphe Ashton and Thomas Chernock such lands as had been sold for and under the trust; and whereas since the order Sir Thomas Ireland of Bewsey, Thomas Brooke, Henry Ogle, William Barnes and Thomas Parr exhibited their bill but no other purchasers, therefore, for that Richard Bould has compounded with other purchases of whom Alexander Denton by grant dated 27 October 1604 is one and has undertaken to make assurance of the lands purchased, it was ordered 27 November 1620 by the Court that Sir Richard Mollyneux, Sir Raphe Ashton and Thomas Chernock should make assurance to Richard Bould of such lands as they had not made assurance of to Sir Thomas Ireland or others; and whereas Sir Richard Mollyneux, Sir Raphe Ashton and Thomas Chernock by deeds bearing date 15 December 1620 have granted to Richard Bould all those lands in Lancashire sold by Sir Edward Fitton and Sir Thomas Bould; Richard Bould grants and sells to Alexander Denton such lands as were the inheritance of Sir Thomas Bould or Richard Bould, deceased, as are in Ditton for ever to hold of the lord or lords by customary dues; and Richard Bould appoints John Ditchfeild of Ditton and Thomas Orme of Lee his attorneys to take possession and seisin of the land and deliver it. Witnesses: John Dichfeild, Thomas Orme, William Bold, Thomas Denton, Edward Denton, Robert Norman. On the back is a certificate of delivery of seisin. Witnesses: John Dichfeild, Thomas Orme, Thomas Johnes, Edward Denton, William Farname.
