Scope and Contents

Traces the title of John Cross of Chesterton, boatwright (2nd party) to two tenements in Brick Kiln Lane, Barnwell, Cambridge. In 1815, Cross mortgaged this property (on the security of a 1,000-year lease) to Samuel Salmon of Cambridge, upholsterer (5th party) for #400, but in 1817 Cross was declared bankrupt and his estate was assigned to his principal creditors William Gray of Chatteris, grocer, and William Nunn of Cambridge, victualler (1st parties). Since no interest is owing upon the mortgage, in consideration of #54 and #400 respectively, the 1st and 2nd parties release the freehold and the mortgage estate to John Swan of Barnwell, yeoman (3rd party). James Wentworth of Cambridge, gent (4th party) is named as Swan's trustee to prevent mesne encumbrances. Indentures, lease (for one year at peppercorn rent) signed and sealed by Gray, Nunn, and Cross (his mark), and witnessed by Joseph Fitch of Cambridge, attorney, and Richard ?Jabram his clerk, duty stamp. Release in form of five-part indenture of 5 pages, signed and sealed by Gray, Nunn, Cross (his mark), Swan (his mark) and Salmon, witnessed as above, with addition of George Henry Bays, clerk to Mr Wentworth, attorney. Duty stamps. Release endorsed with Salmon's receipt for #400 and Gray's and Nunn's receipt for #54, same date and witnesses. Forms of indenture supplied by James Walker, parchment dealer, of Bermondsey. Enclosed is a certificate signed by William Rogers, and dated 20 May 1843, confirming that 'Mr Truefitt of Barnwell' has borrowed #222 on the security of the indentures, and that the principal creditor, Mr ?Pestell, is to hold the deeds as security.
