Whereas by Indenture dated 16 June 1721 [Doc 209] John Austin senior of Shefford and John Austin junior his son mortgaged to George Fennell of Shefford certain land in Shefford for a term of five hundred years; and whereas by Indenture dated 7 July 1721 [Doc 210] John senior mortgaged to Joseph Welch of Great Wymondley, Hertfordshire, certain land in Shefford for a term of five hundred years; and whereas the lands have become vested in George Fennell of Shefford Hardwicke, Bedfordshire, executor of his father George Fennell, and in Samuel Bedford, clerk, of Southill, Bedfordshire executor of Pemberton Bedford, his father; and whereas no more than the interest of the sums concerned has been as yet paid; George Fennell assigns to William Barber of Broad Street, London, the land first mentioned for the remainder of the term of five hundred years subject to equity of redemption; and further Samuel Bedford assigns to William Barber the land last mentioned for the remainder of the term of five hundred years subject to equity of redemption. Witnesses: William Fuller Bedford, Edward Albone. On the back is a receipt for the consideration money signed by George Fennell. Witnesses: the same; and a similar receipt signed by Samuel Bedford. Witnesses: the same. On the back also is a deed as follows: Whereas the sums due are unpaid; and whereas John Austin by bond dated 14 November 1758 became bound to William Barber in a certain sum , the bond to be void on the payment of the original sum; and whereas the original sum is unpaid; John Austin charges the original sum upon the lands assigned, and agrees that the lands shall not be redeemable until the original capital sums are paid.
