Scope and Contents
There is no gaol delivery. With the exception of the Commonwealth period (1652-9), this is the only roll in the series to be entirely in English - following the Proceedings in Courts of Justice Act, 1730 (effective from 1733), English became the obligatory language for written court records.
Wisbech, 6 Aug. 7 Geo II [1733]. Pleas before Charles Clarke, chief justice of the Isle of Ely.
- 1r. Thomas Carter complains against John Suker of Sutton, yeoman, in an action of trespass on the case relating to the right of common pasture in a piece or parcel of fen ground or meadow land comprising seven acres in a field called North Medlands, alias Madlands, forming a customary part of the manor of Sutton, 1 Mar. 1729. To proceed to the next session.
- 1r.-v. Robert Mayor complains against Shepherd Cook of Wisbech St Peter, victualler, and Henry More of Wisbech St Mary, yeoman, in an action of trespass on the case relating to a promissory note made 14 Aug. 1732 at Wisbech St Peter concerning five pounds and 18 shillings. Wisbech, pleas before Charles Clarke, chief justice, 12 Aug. 1734
- 2v. (3) Elisha Smith answered Martin Folkes in an action of debt of 120 pounds relating a bond of obligation of 5 Mar. 1734. The bond of obligation is recited. Smith fined; to pay costs and damages.
- 2v. (4) Martin Wilkin brought a suit against Edward Bilding relating to 50 acres of pasture and 50 acres of marsh with appurtenances in the parish of Doddington. This is a common recovery.
- 3r. -v. (5) Joseph Brand complains against Isabel Cave of Witchford, widow, Thomas Cave of Witchford, yeoman, and Matthew Cave of Witchford, yeoman, in an action of trespass that on 1 Sept. 1733 and on various other dates their livestock trampled and overgrazed the crops growing in Brand’s closes in Wentworth causing damage. To proceed to jury trial.
