Scope and Contents

Correspondence between Charles Hamson and various others concerning the case of Rookes v. Barnard. The correspondence falls into three discrete elements.
The first is concerned with Hamson’s response to an article by Kenneth William (Bill) Wedderburn on the case of Rookes v. Barnard published in the ‘Modern Law Review’ Vol. 24, p.572 in September 1961 and responses to Hamson’s own article ‘Intimidation: A note on Rookes v. Barnard’ published in ‘The Cambridge Law Journal’ in November 1961, and contains correspondence with Wedderburn, Neville Faulks and Otto Kahn-Freund and an uncorrected galley-proof and offprint of Hamson’s article (Aug.-Nov. 1961).
The second element is concerned with Hamson’s objections to a proposal for Bill Wedderburn to do a broadcast for the BBC ‘Law in Action’ series on the Court of Appeal’s judgement in Rookes v. Barnard and contains correspondence with Wedderburn, Terence George Boston, Arthur Lehman Goodhart and Robert Edgar Megarry (Jan.-May 1962).
The third element contains a copy of the House of Lords judgement on Rookes v. Barnard dated 21 January 1964 sent to Hamson by Lord Patrick Devlin, and an exchange of letters between Devlin and Hamson commenting on a Court of Appeal judgement made by Lord Denning in the case of J.T. Stratford & Son Ltd. v. Lindley and another which made reference to Rookes v. Barnard. A press cutting of a report of the judgement published in ‘The Times’ on 26 March 1964 is also included along with some manuscript notes by Hamson. Devlin’s letter also contains a request for travel advice concerning a forthcoming trip to Istanbul for a meeting of the International Press Institute and Hamson replies with advice on weather, clothing, and places and people to visit (Mar.-Apr. 1964).
