Scope and Contents

Preamble: letters patent; writ of assizes; gaol delivery commission.

  1. 1r. William Newman of Ely, labourer, is indicted that on 19 Oct. 1609 he assaulted John Foote at Ely and feloniously took and carried away 42 shillings and nine pence in numbered money from him. Not guilty.
  2. 1v. Henry Merecocke of Chatteris, labourer, is indicted that on 20 Dec. 1609 at Chatteris he feloniously stole, took and led away a bay horse worth three pounds belonging to John Cowper. Not guilty.
  3. 1v. Robert Dennyson of Leverington, labourer, is indicted that on 2 May 1608 he feloniously took and drove a sheep worth ten pence from Henry Bachiler at Leverington. Not guilty.
  4. 1v. William Greene of Downham, labourer, is indicted that on 1 Oct. 1606 he feloniously stole, took and drove a brindled hewed heifer worth 30 shillings from William Apsland at Downham. Not guilty.
  5. 1v. Edward Hall of Ely, yeoman, is indicted that on 29 June 1606 at Ely he fraudulently made and produced diverse writs and testimonials, known as passports, for several unknown persons. Not guilty.
  6. 1v. William Mercott of Chatteris, butcher, is indicted that on 12 Dec. 1609 he feloniously stole, took and drove a sheep worth nine pence from Joan [Tymey], widow, at Chatteris. Guilty; allowed benefit of clergy.
  7. 2r. John Payne of Chatteris, yeoman, and Thomas Byrde of Chatteris, yeoman, are indicted that on 10 Jan. 1610 they assaulted and murdered Anne Walters, the wife of John Walters, at Chatteris. Payne inflicted a mortal wound with a sword and Byrde inflicted a mortal wound with a sword to her stomach. Walters languished for six days and died on 16 Jan. 1610. Byrde guilty, to be hanged; Payne not guilty.
  8. 2r. Richard Gilbye of Wisbech, miller, is indicted that on 1 June 1610 he assaulted and murdered Thomas Artle at Wisbech by inflicting a mortal wound with a mill peck. Guilty; to be hanged.
  9. 2v. Richard Porter of Ely, labourer, is indicted that on 28 Oct. 1609 he feloniously stole, took and carried away a cloak worth 20 shillings from Edward Everett at Ely. Guilty; sentence not stated.
  10. 2v. John Moone of Haddenham, labourer, and Matthew Collyson of Haddenham, labourer, are indicted that on 26 Sept. 1609 they feloniously stole, took and drove the following animals: three red heifers worth 30 shillings each from Thomas Whitlam; three heifers worth 40 shillings each from Nicholas Rasor; two black heifers worth 25 shillings each from John Gell; one black heifer worth 20 shillings from Richard Storer; one brown heifer worth 30 shillings from John Newman; five heifers worth 20 shillings each from John Lockton; two red cattle or oxen worth three pounds from Lancelot Burton; four heifers worth 40 shillings each from Herbert Walcott, gentleman. Confessed; sentence not stated.
  11. 2v. Hugh Sympson of Wisbech, [occupation not stated], is indicted that on 2 Apr. 1610 he feloniously stole, took and carried away a rug or carpet worth ten pence from Thomas Hampshiere at Wisbech. Guilty; to be whipped.
  12. 3r. John Tyrrett of Wisbech, labourer, is indicted that on 23 Nov. 1609 he feloniously stole, took and carried away a sheet worth ten pence from Richard Myles at Wisbech. Confessed; to be whipped.
  13. 3r. John Norman of Ely, yeoman, John Dickenson of Sutton, labourer, William Hillarton of Ely, labourer, Anne Coward of Whittlesey, spinster, John Hamond of Ely, labourer, Roger Goade of Stretham, cleric, George Dennyson of Leverington, yeoman, John Beddingfield of Ely, saddler and Thomas White of Wisbech, [occupation not stated], are freed and acquitted.
  14. 4r. Robert Juman of Whittlesey is bound to answer Henry Harwood in a plea of debt. Thomas Avelyn of Whittlesey, husbandman, acts as surety.
  15. 4r. Robert Browne of Outwell, labourer, is bound to answer Charles Awston in a plea of debt. Francis Parlett of Stradsett, Norfolk, gentleman, acts as surety.
  16. 4r. Alexander Coxon of Walsoken, Norfolk, gentleman, is bound to answer John Payton senior, knight, in a plea of debt. Robert Howdell of Wisbech, gentleman, acts as surety.
  17. 4r. Ralph Sowe of Wisbech, weaver, is bound to answer Thomas Barbill in a plea of debt. Robert Reve of Wisbech, waterman, and Edward Wistocke of Wisbech, bricklayer, act as surety.
  18. 4r. William Grave of Haddenham, victualler, is bound to answer Roger Fletcher in a plea of trespass on the case. Arthur Porter of Stretham, husbandman, acts as surety.
  19. 4r. Edward Browne of Haddenham, yeoman, and William Browne of Haddenham, yeoman, are bound to answer Thomas Tubby in a plea of debt. Edward Meakyn of Haddenham, yeoman, and Cuthbert Browne of Haddenham, yeoman, act as surety.
  20. 4r. Roger Goade of Wicken, cleric, is bound to answer Thomas Arkenstall, gentleman, in a plea of debt. William Barker of Stretham, husbandman, and Andrew Goade of Ely, yeoman, act as surety.
  21. 4r. Thomas Gipps and Arthur Mowse, administrators of the goods and chattels of Roman Dixon lately of Ely, draper, deceased, are bound to answer Seth Chapman in a plea of debt. Andrew Arkenstall of Ely, gentleman, and William Morgan of Ely, draper, act as surety.
  22. 4v. Robert Wilsey of Tydd St Giles, yeoman, Thomas Wynlowe and John Rowe of Tydd St Giles, labourers, answered Arnold Loverye, gentleman, in an action of trespass that on 19 June 1610 they took four cart-loads of hay belonging to Loverye to the value of 40 shillings. Defendants arrested; to pay costs and damages.
  23. 4v. Robert Juman of Eastrea, husbandman, is summoned to answer Henry Harwood in an action of debt of eleven pounds relating to a bond of obligation of 21 Mar. 1608 at Whittlesey. Juman fined; to pay costs and damages.
  24. 4v. Thomas Joyne of Wisbech, brewer, answered John Hames and Joan, his wife, in an action of trespass on the case that on 24 Oct. 1609 at Ely Joyne slandered Joan Hames by publicly saying ‘she is a witch and I will prove it and she has wasted my estate by bewitching of my goods’. Pled not guilty; to proceed to jury trial.
  25. 5r. Thomas Glapthorne of Whittlesey, gentleman, answered John Elmer and Alice, his wife, in an action of trespass on the case that on 20 Nov. 1609 Glapthorne slandered Alice Elmer at Whittlesey by publicly saying ‘she is a witch and an enchanter and has enchanted her son so that he did not feel the blows which I did give him’. Pled not guilty; to proceed to jury trial.
  26. 5r. John Colborne of Emneth, Norfolk, yeoman, is summoned to answer Edmund Meadowe in an action of debt of 20 pounds relating to a bond of obligation of 4 Apr. 1607 at Wisbech. The bond of obligation is recited but not transcribed in the record. The entry is incomplete.
  27. 5v. John Coward and Thomas Neale, [place of abode and occupation not stated], are summoned to answer Richard Cully that on 20 June 1610 they took a 13 foot boat and 62 sheaves of sedge worth 100 shillings from Cully at a place called Lechermere or Lethermere at Elm. To proceed to jury trial.
  28. 5v. John Death and Thomas Sergeant, [place of abode and occupation not stated], are summoned to answer Simon Steward, knight, that on 7 May 1609 they took six steers and 91 sheep belonging to Steward from a place called Thorntons Close at Stuntney. Damages to be assessed.
  29. 6r. Thomas Grippes and Arthur Mouse, administrators of the goods and chattels of Roman Dixon of Ely, draper, deceased, answered Seth Chapman in an action of debt of 226 pounds relating to a bond of obligation agreed during the lifetime of Roman Dixon, 18 Apr. 1608 at Ely. The bond of obligation is recited. To proceed to jury trial.
  30. 6v. John Ivatt of Haddenham, husbandman, answered Henry James in an action of trespass and ejection that on 9 July 1610 he ejected James from a messuage and one acre of pasture with appurtenances in Haddenham which Elizabeth Tompson, widow, had leased to James for a term which had not yet expired. Pled not guilty; to proceed to jury trial.
  31. 6v. John Okey, second son of John Okey of Haddenham, yeoman, answered John Avrye in a plea of trespass on the case relating to the possession of a horse worth six pounds, 10 June 1610 at Haddenham. Avrye fined for bringing a false claim.
  32. 7r. William Edwards of Wisbech, gentleman, answered John Hey in a plea of trespass on the case relating to the sum of 39 shillings, 17 June 1610 at Wisbech. Damages to be assessed.
  33. 7r. Roger Blogget, [place of abode and occupation not stated], answered Robert Smyth in a plea of trespass on the case relating to the sale and supply of six bushels of wheat, 15 Dec. 1608 at Wisbech. Pled not guilty; to proceed to jury trial.
  34. 7v. Benedict Cooper of Chatteris, husbandman, answered John Meriell in a plea of trespass on the case relating to the sale and supply of a gelding and two horses, 2 Nov. 1607 at Chatteris. Pled not guilty; to proceed to jury trial.
  35. 7v. Benedict Granger of Downham, labourer, answered Robert Lancaster in a plea of trespass on the case relating to the possession of a tenement with appurtenances in Ely and three acres of arable land in Downham, 25 Mar. 1603. To proceed to jury trial.
  36. 8r. Richard Harryson of Wilburton, husbandman, answered Margaret Owtlawe in an action of trespass that on 14 Aug. 1608 he broke and entered her marsh land, called a six pole lot, lying in a marsh called [Leasure], mowed or cut the grass growing there and on 20 Sept. 1608 took and carried away piles of sheaves to the value to ten pounds. Damages to be assessed.
  37. 8r. Edward Nicholson of Wilburton, labourer, answered Margaret Owtlawe in an action of trespass that on 20 Sept. 1608 at a marsh called the [Leasure] he took 4000 sheaves of hay to the value of ten pounds and pitched the piles on a wagon using a pitchfork with Richard Harryson. Damages to be assessed.
  38. 8r. William Hovill is summoned to answer John Usher in an action that on 6 Aug. 1608 he took a horse from a place called [Golesomore] at Thetford. Damages to be assessed.
  39. 8v. William Hovill is summoned to answer John Usher in an action that on 11 Aug. 1608 he took seven milk cows belonging to Usher from a place called [Gowlesmore] at Thetford. Damages to be assessed.
  40. 8v. Simon Saunders of Littleport, waterman, is summoned to answer Edward Pratt, gentleman, in an action of debt of six pounds relating to a bond of obligation of 25 Sept. 1609. Saunders fined; to pay costs and damages.
  41. 8v. Thomas Reymond of Ely, baker, is summoned to answer Edward Neale in an action of debt of ten pounds relating to a bond of obligation of 7 Apr. 1609. Reymond fined; to pay costs and damages.
  42. 9r. John Ascue, [place of abode and occupation not stated], is summoned to answer Adam Robynson in an action of debt of six pounds relating to a bond of obligation of 25 Oct. 1607 at Ely. Ascue fined; to pay costs and damages.
  43. 9r. Nicholas Knowles of Ely, baker, answered Robert Gonnell in an action of trespass that on 2 June 1610 he entered Gonnell’s house at Ely and took and carried away a pewter worth ten shillings. Damages to be assessed.
  44. 9r. William Harwood of Whittlesey, tailor, Henry Kirby and Robert Searle junior of Whittlesey, labourers, answered William Watts in an action of trespass that on 6 Mar. 1610 they entered Watts’ close at Whittlesey, trampled the grass growing there with their feet and ploughed the land causing damage. Pled not guilty; to proceed to jury trial.
  45. 9v. William Levitt of Ely, butcher, answered Thomas Crispe, gentleman, in an action of trespass that on 15 Mar. 1610 he took and led away two milk cows worth six pounds from Crispe’s close at Ely. Pled not guilty; to proceed to jury trial.
  46. 9v. William Meales of Wentworth, husbandman, is summoned to answer Thomas Tubby in an action that on 15 Mar. 1610 he took six milk cows from a place called the close, or the staple, at Wentworth. There is discussion on the ownership of various pieces of land. To proceed to the next session.
  47. 10r. William Grave of Haddenham, butcher, answered Roger Fletcher in an action of trespass on the case that on 10 June 1610 at Haddenham he slandered Fletcher by saying in the presence of several people that Fletcher was a perjured knave. Guilty; to pay costs and damages.
  48. 10v. Robert Huggell of Wisbech, shearman, is summoned to answer Andrew Robynson in an action of debt of 40 shillings relating to or as a result of an arbitration, 20 Sept. 1608 at Wisbech. Huggell fined; to pay costs and damages.
  49. 10v. Benedict Lesse of Wiggenhall St Mary, Norfolk, carpenter, is summoned to answer Matthew Clarke esquire in an action of debt of 100 shillings relating to the lease of a messuage with appurtenances in Terrington St Clement. Leese fined; to pay costs and damages.
  50. 10v. John Gooday of Haddenham, yeoman, is summoned to answer Anne Drake in an action of debt of four pounds relating to a bond of obligation of 10 Dec. 1609 at Haddenham. The bond of obligation is recited. To proceed to the next session.
  51. 11r. Richard Scortred of Walsoken, Norfolk, butcher, answered Thomas Buckworth, gentleman, in an action of trespass on the case relating to the purchase of 20 steers or [Herefords] for the sum of 16 pounds, 4 June 1609 at Wisbech. Pled not guilty; to proceed to jury trial.
  52. 11r. Hugh Crispe of Wisbech, fishmonger, is summoned to answer Christopher Evered in an action of debt of 54 shillings relating to the sale and supply of a barrel of soap, 21 Sept. 1607 at Wisbech. The entry is incomplete.
  53. 11v. William Serle of Whittlesey, husbandman, answered John Elmer and Alice, his wife, in an action of trespass and assault that on 6 Apr. 1609 he assaulted Alice Elmer at Whittlesey putting her in fear of her life. Pled not guilty; to proceed to jury trial.
