Scope and Contents
Preamble: letters patent; writ of assizes; gaol delivery commission.
- 1r. Alice Elmer of Whittlesey, spinster, is indicted that on 25 Aug. 1607 she feloniously stole, took and carried away 24 hemp sheaves to the value of ten pence from Edward Whyte at Whittlesey. Not guilty.
- 1v. William Fynch of Haddenham, labourer, is indicted that on 29 Dec. 1607 he assaulted and wounded William Pytts by violently affixing his legs with chains and locks causing his legs to rot or putrefy. Not guilty.
- 1v. John Haynes of Whittlesey, labourer, is indicted that on 29 Dec. 1607 he feloniously stole, took and carried away 120 pouts [fish] to the value of 11 pence from a net belonging to William Fryer and on the same day a grig to the value of nine pence and a net worth 18 pence from John Davye at Whittlesey. Guilty of first indictment, guilty of theft of net in the second indictment; allowed benefit of clergy.
- 1v. Thomas Parret of Tydd St Giles, labourer, is indicted that on 11 Feb. 1608 he feloniously stole, took and drove nine hoggerels [young sheep] worth 30 shillings from William Walbutt at Tydd St Giles. Guilty; allowed benefit of clergy.
- 1v. Nicholas Hawkyns of Wilburton, baker, is indicted that on 9 May 1608 he feloniously stole, took and carried away two milks worth 30 shillings each from Robert Chamberleyne at Wilburton. Guilty; allowed benefit of clergy.
- 2r. William Layton of Newton, labourer, George Atkinson of Newton, labourer, and Matilda Dayly, wife of William Dayly of Newton, spinster, are indicted that on 1 Jan. 1608 at about 11 o’clock at night they burgled the house of Thomas Gunton, gentleman, at Newton, and took and carried away a table cloth to the value of 12 pence and 16 cheeses to the value of eight shillings. Layton guilty, allowed benefit of clergy; Dayly not guilty; Atkinson did not appear.
- 2r. John Smyth, alias Clowe, of Witchford, labourer, is indicted that on 27 Mar. 1608 he feloniously stole, took and carried away a sheet worth two shillings and six linen yarns worth two shillings from Thomas Ball at Witchford. He is further indicted that on 10 Apr. 1608 he feloniously stole, took and carried away a coulter worth two shillings from Paul Yonge at Witchford. Not guilty of first indictment; guilty of second indictment, to be hanged.
- 2r. Zacharias Steward of Outwell, labourer, is indicted that on 20 May 1608 he assaulted Percy Medley with a dagger, inflicting a mortal wound to his stomach, causing Medley to languish and die on 22 May 1608. Guilty; to be hanged.
- 2v. William Edes of Haddenham, yeoman, is indicted that on 2 Apr. 1608 at Haddenham, he assaulted, raped and carnally knew Elizabeth Chester contrary to statute. Edes is not found.
- 2v. Richard Ashon, alias Mansall, of Elm, labourer, is indicted that on 1 Apr. 1608 he feloniously stole, took and carried away half a pound of hair to the value of six pence which he had cut from the mane a horse belonging to James Dudley and on the same day a pound of hair worth 12 pence which he had cut from three horses belonging to George Spencer. Guilty; to be whipped.
- 2v. William Murcock of Chatteris, butcher, Edward Murcock of Chatteris, husbandman, Robert Turner of Whittlesey, husbandman, George Denyson of Leverington, labourer, Robert Dennyson of Leverington, labourer, Thomas Duffield of Ely, labourer, John Harryson of Ely, labourer, Brian Wigglesworth of Newton, labourer, John Saunders of Wisbech, labourer, Thomas Pigg of Tydd St Giles, husbandman, William Tedman of March, waterman, George Day of Witcham, labourer, and Nicholas Drake of Doddington, husbandman, are freed and acquitted.
- 3r. William Alston of Middleton, Essex, yeoman, is bound to answer John Usher in an action of trespass on the case. Henry Melksopp of Littleport, gentleman, acts as surety.
- 3r. John Knott of Brandon, Suffolk, waterman, is bound to answer Toby Chapman in an action of trespass on the case. Edward Everard of Ely, yeoman, and Robert Harryson of Ely, scrivener, act as surety
- 3r. Christopher Pierson of Wisbech, cordwainer, is bound to answer John Mansfield in an action of debt. Richard Blanck of Leverington Parson’s Drove, yeoman, acts as surety.
- 3r. Thomas Daysye of Stretham, shepherd, is bound to answer Thomas Haynes in an action of debt. John Clarke of Ely, yeoman, acts as surety.
- 3r. Robert Page of King’s Lynn, Norfolk, [occupation not stated] is bound to answer Thomas Joynes in an action of trespass on the case. Samuel Alchian of Ely, yeoman, acts as surety.
- 3r. Henry Peacock, [place of abode and occupation not stated] is bound to answer Edmund Humfrey in an action of debt. Edward Hall of Haddenham, yeoman, acts as surety.
- 3r. John Tyler of Soham, yeoman, is bound to answer John Nyx in an action of debt. Edward Phipers of Haddenham, yeoman, acts as surety.
- 3v. Robert Page of King’s Lynn, Norfolk, [occupation not stated], answered Thomas Joyne in an action of trespass on the case relating to information presented by Page on behalf of the Crown at an earlier session concerning Thomas Joyne’s occupation as a beer brewer between 25 Sept. 1604 and 3 Sept. 1605. Pled not guilty; to proceed to jury trial.
- 3v. Christopher Pierson of Wisbech, cordwainer, is summoned to answer John Mansfield in an action of debt of ten pounds relating to a bond of obligation of 15 May 1607. Pled not guilty; to proceed to jury trial.
- 4r. Edward Stokeley of Leverington, blacksmith, answered Robert Wiglesworth in an action of trespass on the case that on 15 May 1608 he slandered Wiglesworth by publicly saying that Wigglesworth dipped a sheep which did not belong to him on his last dipping day, branded that sheep with his own brand and has kept it in his flock. Pled not guilty; to proceed to jury trial.
- 4r. Thomas Nordwell of March, waterman, answered Richard Cox in an action of trespass that on 22 Dec. 1607 he entered Richard Cox’s barge at Wisbech and took a hogshead of claret wine which belonged to Osmond Edwards. Pled not guilty; to proceed to jury trial.
- 4v. Nicholas Mayne of Whaplode, Lincolnshire, labourer, is summoned to answer John Browne in an action of debt of seven pounds relating to the sale of five steers and two heifers, 30 Nov. 1606 at Wisbech. Pled not guilty; to proceed to jury trial.
- 4v. Simon Saunders of Littleport, labourer, answered Robert Grymer in an action of trespass on the case relating to a debt of five pounds and the supply of 20 thousand [?aired] hassocks. Pled not guilty; to proceed to jury trial.
- 4v. Nicholas Mayne of Whaplode, Lincolnshire, labourer, answered Anthony Dixon in an action of trespass on the case relating to the sale and supply of eight heifers on 1 Nov. 1606 at Wisbech. Pled not guilty; to proceed to jury trial.
- 5r. Henry Howland of Ely, baker, is summoned to answer in an action of debt of 40 shillings relating to the sale of three coombs of wheat, 20 July 1605 at Ely. Pled not guilty; to proceed to jury trial.
- 5r. Richard Crosley of Ely, labourer, answered Philip [Axey] in an action of trespass on the case that on 25 Apr. 1608 he slandered [Axey] by publicly calling him a thief, an errant thief and as errant a thief as any within the Isle. Pled not guilty; to proceed to jury trial.
- 5v. Robert Webster of Upwell, waterman, answered William Chapman in an action of trespass on the case relating to a boat belonging to Webster, 13 Oct. 1606 at Upwell. The entry is incomplete.
- 5v. William Boston, alias Tyler, of Terrington St John, Norfolk, [occupation not stated], answered Edward Middlton and Catherine, his wife, in an action of trespass on the case that on 20 Mar. 1607 Boston slandered Catherine by saying publicly ‘Catherine is a witch and hath witched my cattle to death and if I had not looked out for it thou wouldst have witched me and all the ever I have.’ Pled not guilty; to proceed to jury trial.
- 6r. William Eagar of Tydd St Giles, husbandman, answered John Braband in an action of trespass on the case relating to a debt of 53 shillings, one pence and one halfpenny, 21 Oct. 1607 at Tydd St Giles. Pled not guilty; to proceed to jury trial.
- 6r. John Pierson of March, fisherman, answered Thomas Walsham in an action of trespass on the case the on 10 Aug. 1607 he slandered Walsham in the presence of Henry Hobard, knight, and others by saying [at the gaol delivery session] that Walsham feloniously stole, took and carried away 30 eels worth ten pence. Pierson acquitted; Walsham fined for bringing a false claim.
- 6v. Abdias Denton, [place of abode and occupation not stated], answered Bartholomew Wormell in an action of trespass on the case relating to the sale and supply of 11 ends of English iron weighing 408 pounds. Pled not guilty; to proceed to jury trial.
- 6v. Samuel Alchin of Ely, yeoman, is summoned to answer James Weston esquire, Bailiff of the Liberty, in an action of debt of ten pounds relating to a bond of obligation of 23 Apr. 1607. Fined; to pay costs and damages.
- 6v. Henry Chasey of Ely, cooper, is summoned to answer James Weston esquire, Bailiff of the Liberty, in an action of debt of ten pounds relating to a bond of obligation of 23 Apr. 1607. Fined; to pay costs and damages.
- 7r. William Alston of Middleton, Essex, yeoman, answered John Usher in an action of trespass on the case relating to a debt of 36 pounds and the lease of two messuages with malt houses, curtilages, gardens and orchards, 18 Feb. 1608 at Stretham. Alston arrested; to pay costs and damages.
- 7r. Richard Burges of Whittlesey, baker, and Joan, his wife, answered Henry Holland and [Edmee], his wife, in an action of trespass on the case that on 8 May 1608 Joan slandered Edmee by publicly accusing her of taking and stealing a bowl full of meal from her house. Damages to be assessed.
- 7v. Thomas [Comiton] of Wisbech, chandler, answered George [Rosse] in an action of trespass that on 30 Sept. 1607 he broke and entered the close and house of [Rosse] in Wisbech called Tymber Market and occupied the property until 1 May following. Damages to be assessed.
- 7v. Robert Turner of Whittlesey, husbandman, answered William Watts in an action of trespass that on 3 July 1608 he entered Watts’ close at Whittlesey, and took and carried away onions and garlic to the value of ten shillings. Damages to be assessed.
- 7v. Thomas Baldwyn of Wisbech, butcher, is summoned to answer Thomas Wensley in an action of debt of 80 shillings relating to a bond of obligation of 6 Aug. 1606 at Wisbech. Baldwyn fined; to pay costs and damages.
- 8r. Edmund Juman, [place of abode and occupation not stated], answered Edmund Smarte in an action that on 31 Dec. 1608 he took a cow belonging to Smarte at Ely. Damages to be assessed.
- 8r. Giles Chapman, gentleman, is summoned to answer John Thorowgood in an action that on 11 Oct. 1607 he entered the croft of William [Parmefay] at Witcham and took nine pigs and one boar belonging to Thorowgood. Damages to be assessed.
- 8r. Margery Saunderson, widow and administrator of the goods and chattels of David Saunderson, lately her husband, who died intestate, is summoned to answer Thomas Pamplyn in an action of debt of eight pounds relating to a bond of obligation of 30 Mar. 1605 at Littleport. Saunderson fined; to pay costs and damages.
- 8v. Cuthbert Browne of Haddenham, yeoman, is summoned to answer Thomas Malyn in an action of debt of ten pounds relating to a bond of obligation of 18 Mar. 1595. Browne fined; to pay costs and damages.
- 8v. Richard Jegon of Streatham, yeoman, is summoned to answer Thomas Deyes in an action of debt of 40 shillings relating to his employment as a farmer or husbandman for a period of one year, 1 Oct. 1606 at Ely. Pled not guilty; to proceed to jury trial.
- 8v. Roger Atkinson, [place of abode and occupation not stated], answered George Gardner in an action of trespass that on 10 July 1608 his livestock overgrazed and trampled on the wheat growing in Gardner’s close at Wimblington Field in Wimblington. Damages to be assessed.
- 9r. William Scortred of Wisbech St Mary, butcher, answered William Stermyn esquire in an action of trespass on the case relating to the sale of six cattle, 20 Dec. 1601 at Wisbech. Scotred acquitted; Stermyn fined for bringing a false claim.
- 9r. Thomas Disborowe of Elm, husbandman, and Margaret, his wife, answered Thomas Silt and Alice, his wife, in an action of trespass and assault that Margaret on [day and month not stated] 1608/9 entered the close of Silt at Elm and assaulted Alice. Pled not guilty; to proceed to jury trial.
- 9v. John Watson of Elm, tailor, and Alice, his wife, answered Thomas Silt and Alice, his wife, in an action of trespass and assault that John and Alice Watson on [day and month not stated] 1608/9 entered the close of Thomas Silt and assaulted Alice Silt. Pled not guilty; to proceed to jury trial.
- 9v. Robert Martyn of Sawtry, Huntingdonshire, is summoned to answer Alice Medcalf in an action of debt of 100 shillings, 4 May 1607 at Whittlesey. Martyn fined; to pay costs and damages.
