Preamble: letters patent; writ of assizes; gaol delivery commission.

  1. 1r. John Chichely of Ely, labourer, is indicted that on 20 Jan. 1606 he feloniously stole, took and drove two ewes worth four shillings each from John Rutterpide, four wethers worth six shillings each from William Cropwell, four wethers worth five shillings each and eight ewes worth four shillings each from Thomas Jepson, three wethers worth six shillings each and two ewes worth five shillings each from Edward Smyth, six wethers worth six shillings each and five ewes worth five shillings each from Edward North, and 11 ewes worth five shillings each and a wether worth six shillings from John Russell, all at Ely. Guilty; allowed benefit of clergy.
  2. 1v. Thomas Berry of Well, labourer, is indicted that he feloniously stole, took and drove six red steers worth 40 shillings each and five black steers worth 20 shillings each on 1 Dec. 1605, 40 wethers worth eight shillings each on 25 June 1605, three red steers worth 20 shillings each and three black heifers worth 20 shillings each on 20 July 1605, and 40 ewes worth five shillings each, two wethers worth six shillings each and two rams worth eight shillings each, all from Thomas Thursby esquire at Well. He is further indicted that he feloniously stole, took and drove a black horse and a pale worth three pounds from Richard Chapman at March, 1 Nov. 1605, and two horses, one dark bay worth three pounds and the other bright bay worth 50 shillings and three colts worth 40 shillings each from a certain Blacklocke at Elm, 1 May 1605. Not guilty of the first indictment; guilty of other indictments, to be hanged.
  3. 1v. Mary Smyth of Downham, spinster, is indicted that on 31 Oct. 1605 she set fire to the thatch roof of Edward Chawner’s dwelling house at Downham causing the house to be consumed and destroyed. Guilty; to be hanged.
  4. 1v. John Emerson of Wisbech, labourer, is indicted that on 15 Mar. 1606 he burgled the dwelling house of William Maye at Wisbech between the hours of 11 and 12 in the night, assaulted Emerson putting him in fear of his life and feloniously stole eight pounds in numbered money and a piece of gold worth ten shillings. Guilty; to be hanged.
  5. 2r. Isabelle Browne of Wisbech, spinster, is indicted that on 30 June 1606 she feloniously stole, took and carried away a waistcoat worth ten pence from Thomas Wytters at Wisbech. Confessed; to be whipped.
  6. 2r. William Wells of March, labourer, is indicted that on 13 July 1606 he feloniously stole and drove two lambs worth five pence each from John White at March. Confessed; to be whipped and put in stocks.
  7. 2r. Jeremiah Hutton of Ely, labourer, Edward Berry of Littleport, labourer, Abraham Reynolds of Haddenham, labourer, John Norman of Haddenham, labourer, and Thomas Perken of Haddenham, labourer, are freed and acquitted.
  8. 3r. John Collyer of Walsoken, Norfolk, butcher, is summoned to answer John Downham, executor of the will and testament of Helen Downham, in an action of debt of ten pounds relating to payment for the sale of ten rams, four cattle and two steers, 10 Jan. 1606 at Wisbech. Pled not guilty; to proceed to jury trial.
  9. 3r. John Phillippson of Colne, Huntingdonshire, husbandman, and Richard Phillippson of Somersham, Huntingdonshire, labourer, answered Francis Readman in an action of trespass that on 1 Sept. 1602 they entered Readman’s close at a place called the Delphes at Haddenham and took and carried away ten cart-loads of hay worth 100 shillings. Pled not guilty; to proceed to jury trial.
  10. 3v. John Byshopp, [place of abode and occupation not stated], answered Richard Gates in an action of trespass that on 1 Sept. 1604 his livestock trampled and overgrazed the grass in Gates’ close at Leverington Parson’s Drove causing damage. Pled not guilty; to proceed to jury trial.
  11. 3v. John Watts of Ely, yeoman, answered Michael Auger in an action of trespass on the case relating to the possession of cow worth four marks, 14 Sept. 1605 at Ely. Pled not guilty; to proceed to jury trial.
  12. 3v. Emanuel Dixon of Guyhirn, labourer, answered Elizabeth Peapes, widow, in an action of trespass that on 31 Mar. 1606 he entered the close of Peapes at Guyhirn. Pled not guilty; to proceed to jury trial.
  13. 4r. Alexander Scrogge of Haddenham, gentleman, and Anthony Dobson of Haddenham, husbandman, answered Edward Kyrke in an action of trespass that on 10 July 1606 they entered the close of Kyrke at Aldreth in the parish of Haddenham, and mowed and trampled the grass growing there with their feet causing damage. Pled not guilty; to proceed to jury trial.
  14. 4r. John Gymitt of Wisbech, labourer, answered Thomas Joyne in an action of trespass on the case and breach of promise relating to the sale and supply of three kilderkins of strong beer, 7 Nov. 1605 at Wisbech. Pled not guilty; to proceed to jury trial.
  15. 4r. Andrew Neale of March, [occupation not stated], answered James Whimell in an action of trespass on the case relating to the possession of a heckfer [heifer] worth 50 shillings, 21 Dec. 1605 at March. Pled not guilty; to proceed to jury trial.
  16. 4v. Roger Gare of Walpole, Norfolk, yeoman, answered Thomas Joyne in an action of trespass on the case relating to the sale and supply of two kilderkins of ordinary beer on 24 Feb. 1605 at Wisbech and four kilderkins of strong beer on 15 Mar. 1605 at Wisbech. Pled not guilty; to proceed to jury trial.
  17. 4v. Thomas Crispe of Ely, gentleman, is summoned to answer John Thompson, gentleman, in an action of debt of 40 shillings, 27 Aug. 1604 at Ely. Pled not guilty; to proceed to jury trial.
  18. 5r. [?Origemis] Musgrave of Upwell, labourer, answered Roger Bloggett in an action of trespass on the case relating to the possession of a broken French crown worth six shillings, a piece of a silver spoon worth three shillings and a silver ring worth two shillings. Pled not guilty; to proceed to jury trial.
  19. 5r. Nicholas Smalley of Haddenham, yeoman, answered John Payne in an action of trespass and ejection that on 19 June 1606 he ejected Payne from a messuage with appurtenances in Haddenham which Elizabeth Thompson had leased to Payne for a term which had not yet expired. Pled not guilty; to proceed to jury trial.
  20. 5v. William Foster, [place of abode and occupation not stated], answered Michael Alexander in an action of trespass on the case relating to the promise to heal and cure Anne, the wife of Robert Nicholson, and Agnes Baldwer, widow, from a pox or sickness [morbo gallico], 10 Mar. 1604 at Wisbech. Pled not guilty; to proceed to jury trial.
  21. 5v. Edward Byshopp, [place of abode and occupation not stated], answered Thomas Rogers in an action of trespass on the case relating to the possession of a tenement with appurtenances in Sutton and the sale of a lodge, a sheep press and two pieces of oak timber, 5 May 1606.
  22. 6r. Thomas Cobuton of Wisbech, fishmonger, is summoned to answer Henry Pecke in an action of debt of 40 shillings relating to a bill of 27 Feb. 1605. Pled not guilty; to proceed to jury trial.
  23. 6r. Cuthbert Browne of Haddenham, yeoman, is summoned to answer Richard Fryerson in an action of debt of three pounds relating to a bond of obligation of 2 Apr. 1605 at Haddenham. Pled not guilty; to proceed to jury trial.
  24. 6r. Francis Chapman of March, labourer, answered Thomas Granger in an action of trespass on the case relating to the sum of 22 shillings and six pence [to be paid] over a period of nine weeks. Pled not guilty; to proceed to jury trial.
  25. 6v. William Pygge of Guyhirn, labourer, answered John Reppes esquire in an action of trespass that on 1 Sept. 1605 he entered Reppes’ close at Guyhirn. Pygge states the action is not sufficient in law. To proceed to jury trial.
  26. 6v. Elizabeth Tymworth of Wisbech, widow and administrator of the goods and chattels of William Tymworth, late of Wisbech, tanner, who died intestate, answered Thomas Wensley in an action of debt of 78 pounds relating to a bond of obligation of 16 Aug. 1602. Tymworth fined; to pay damages.
  27. 6v. William Broke of Ely, millwright, is summoned to answer Philip Gotobed in an action of debt of 46 shillings and eight pence relating to the sale of a horse, 7 June 1606 at Ely. Broke fined.
  28. 7r. William Goodson of Haddenham, labourer, is summoned to answer Edmund Humfrey in an action of 80 shillings relating to the sale and supply of 10 coombs of seed barley, 4 Apr. 1604 at Ely. Goodson fined; to pay damages.
  29. 7r. John Bath of Ely, butcher, is summoned to answer William Cranford in an action of debt of 45 shillings which he borrowed from Cranford, 16 Sept. 1605 at Ely. Bath fined; to pay damages.
  30. 7r. Thomas Claxon, [place of abode and occupation not stated], is summoned to answer Francis Chrysmas in an action of debt of 40 shillings relating to the sale and supply of six lambs worth 30 shillings, 23 Apr. 1606 at Chettisham. Claxon fined; to pay damages.
  31. 7r. Reginald Ruddye of Doddington, [occupation not stated], answered Henry Tucke, gentleman, in an action of trespass that on 7 Nov. [year not stated] he entered the house and storehouse of Tucke at Doddington and his livestock overgrazed, trampled and consumed Tucke’s peas and beans to the value of three pounds, six pence and eight shillings. Damages to be assessed.
  32. 7v. John Reade of West Walton, Norfolk, yeoman, answered William Pygge and Mary, his wife, in an action of trespass and assault that on 9 July 1606 he assaulted Mary at Wisbech, drawing blood and putting her in fear of her life. Damages to be assessed.
  33. 7v. Thomas Baldwyn, alias Bauldwyn, of Wisbech, butcher, is summoned to answer Thomas Wensley in an action of debt of six pounds relating to a bond of obligation of 28 Nov. 1604 at Wisbech. Baldwyn fined; to pay damages.
  34. 7v. John Wilson of Ely, labourer, is summoned to answer William March, gentleman, in an action of debt of 40 shillings relating to a bond of obligation of 13 Apr. 1602 at Ely. Wilson fined; to pay damages.
  35. 7v. Joseph Emneth of Emneth, Norfolk, yeoman, and Thomas Sumpter of Emneth, yeoman, answered John Goddard, gentleman, in an action of trespass that on 6 Jan. 1606 they removed 20 joists from Goddard’s stable at Downham, took and carried away trees and plants growing in his garden and also took and carried away boards [with keys or screws], three stock locks, shelves and several pieces of timber from his dairy house. Damages to be assessed.
  36. 8r. Richard Smyth of Ely, labourer, answered Thomas Wilson in an action of trespass on the case that on 1 Apr. 1605 et Ely he slandered Wilson, publicly saying that a certain William March had had him (Smyth) arrested upon a bond of 40 pounds which he never sealed and that the bond was forged by March and Robert Harryson, together with Wilson and a certain Thomas Hassard. Pled not guilty; to proceed to jury trial.
  37. 8r. John Farrer of Sutton St James, Lincolnshire, yeoman, answered George Wilson in an action of trespass on the case relating to arbitration and a disputed sum of money, 20 Mar. 1606. Pled not guilty; to proceed to jury trial.
  38. 8v. John Goodyer of Tydd St Giles, yeoman, answered John Watson in an action of trespass on the case relating to the sale of horse for the sum of five pounds, six shillings and eight pence, 1 Aug. 1605 at Wisbech. Damages to be assessed.
  39. 8v. William Marrett of Whittlesey, yeoman, alias husbandman, is summoned to answer Henry Radgate in an action of debt of five marks relating to a bond of obligation of 4 Oct. 1604 at Wisbech. Marrett fined; to pay damages.
  40. 8v. Robert Cokyne of Wilburton, husbandman, is summoned to answer Roger Roade in an action of debt of six pounds relating to a bond of obligation of 15 July 1604 at Ely. Cokyne fined; to pay damages.
  41. 9r. Thomas Poynter of Emneth, Norfolk, labourer, is summoned to answer Margaret Musset, widow and executor of the last will and testament of Thomas Musset of Downham Market, labourer, in an action of debt of 80 shillings relating to a bond of obligation of 14 Aug. 1599 at Wisbech. Poynter fined; to pay damages.
  42. 9r. Thomas Poynter of Emneth, Norfolk, labourer, is summoned to answer Margaret Musset, widow and executor of the last will and testament of Thomas Musset of Downham Market, labourer, in an action of debt of 80 shillings relating to a bond of obligation of 14 Aug. 1599 at Wisbech. Poynter fined; to pay damages.
  43. 9r. Matthew Hely of Littleport, cleric, is summoned to answer William Edes in an action of debt of 30 pounds relating to a bond of obligation of 12 May 1606 at Haddenham. The bond of obligation is recited. Hely fined; to pay damages.
  44. 9v. Thomas Travell of Haddenham, husbandman, and John Proctor of Haddenham, husbandman, and Agnes, his wife and executor of the last will and testament of Richard Farrar, are summoned to answer William [?Toanes] and Joan, his wife, executor of the last will and testament of Thomas Dobson, in turn the executor of the last will and testament of his father John Dobson, in action of debt of three pounds relating to a bill of obligation, 17 Apr. 1590, between Richard Farrar and John Dobson. To proceed to jury trial.
  45. 9v. John Payne of Haddenham, husbandman, answered Edward Phipers in an action of [trespass on the case] relating to the lease of a messuage, 30 acres of land and ten acres of pasture with appurtenances in Hill Row in the parish of Haddenham, 1 Mar. 1604.
