Wisbech, 5 Apr. 3 Jas I [1605]: Pleas and gaol delivery before North and others. Preamble: letters patent; writ of assizes; gaol delivery commission.

  1. 1r. Robert Grymey of Newton, labourer, is indicted that on 3 Jan. 1605 he feloniously stole, took and led away a grey horse worth 40 shillings from William Westall at Newton. Not guilty.
  2. 1r. Robert Preston of Sutton, labourer, is indicted that on 10 Jan. 1605 he feloniously stole, took and carried away a [hen] worth four pence from William Cott at Sutton. Not guilty.
  3. 1v. Agnes Westlande of Sutton, spinster, is indicted that on 11 Jan. 1605 she used, exercised and practiced enchantments, witchcraft and magical arts on Elizabeth Cheesewright at Sutton causing her to languish and die. Not guilty.
  4. 1v. Mark Gardyner of Ely, labourer, is indicted that on 1 Jan. 1605 he feloniously stole and drove a white ewe worth ten pence from Thomas Styward, knight, at Ely. He is indicted that on 30 Oct. 1604 he burgled the dwelling house of Richard Rayner at Downham at about 11 o’clock at night and feloniously stole, took and carried away nine shillings and five pence in numbered money. He is indicted that on 3 Jan. 1605 he feloniously stole, took and carried away 15 pence in numbered from Thomas Lynsey at Downham. Confessed to first indictment; guilty of other two indictments, allowed benefit of clergy.
  5. 1v. John Warde of Whittlesey, [occupation not stated], is indicted that on 7 Feb. 1605 he feloniously took and carried away one measure of malt worth ten pence from William Marryott at Whittlesey. Confessed; to be whipped.
  6. 1v. Elizabeth Meaborne of Wisbech, spinster, is indicted that on 1 Oct. 1604 she feloniously stole, took and carried away two handkerchiefs and a coif worth three pence and a stomacher worth three pence from John Crosse at Wisbech. Confessed; to be whipped.
  7. 1v. Gabriel Ruddy of Mepal, labourer, is indicted that on 10 Jan. 1605 he feloniously stole, took and drove two white ewes worth ten pence from Alexander Wrattam at Mepal. Confessed; to be whipped.
  8. 2r. Margaret Burrowed of Wisbech, spinster, is indicted that on 3 Nov. 1604 she feloniously stole, took and carried away two and a half pounds of hemp worth ten pence from William Vavysor at Wisbech. Confessed; to be whipped.

Mary Saunders of Wilburton, widow, and William Saunders of Wilburton, husbandman, answered George Alcock, gentleman, in an action of trespass that on 2 July 1604 they, together with Joan Clarke of Wilburton, widow, broke and entered Alcock’s close at Wilburton called [a three pole ground through the leisure] and took and carried away 20 cart-loads of hay worth ten pounds. Pled not guilty.
  11. 3v. Richard Wysbich of Littleport, yeoman, answered Hugh Miller in an action of trespass that on 14 May 1604 he took and led away a foal from Miller at Littleport. Wysbich arrested; to pay damages.

William Hall and Jane, his wife, [place of abode and occupation not stated] answered Nicholas Massey, gentleman, in an action of trespass that on 20 Aug. 1605 they entered the close of Massey at Ely called Sympson’s Orchard and took and carried away ten coombs of apples and three coombs of [?pears] to the value of 43 shillings. Ralph Holmes of Ely, tailor, answered Nicholas Massey, gentleman, in an action of trespass that on 23 Mar. 1605 he entered the close of Massey lying in the parish of Ely St Mary and took and carried away six posts, 12 bars and 100 poles, and his livestock also overgrazed and trampled the grass growing there causing damage. Holmes acquitted; Massey fined for bringing a false suit.
  31. 7r. John Dunynge of Stretham, yeoman, answered John Kyrke in an action of trespass on the case relating to the possession of 60 hundreds of fodder to the value of three pounds and four shillings, 10 May 1602 at Stretham. Pled not guilty; to proceed to jury trial.

  1. 11r. [45] Reginald Ballock of Haddenham, yeoman, is indicted that on 18 Aug. 1603 he feloniously stole, took and carried away a cart-load of hay to the value of eight shillings from George Younge at Haddenham. Not guilty.
  2. 11r. [46] Robert Whitakers of Leverington, labourer, and John Orvye of Leverington, labourer, are indicted that on 17 Dec. 1603 they feloniously stole, took and carried away a mattress to the value of 12 pence, two feather pillows to the value of eight pence, a pair of tongs to the value of two pence and a pair of [boots or leggings] to the value of four pence from Agnes Thorpe, widow, at Leverington. They are also indicted that on 18 Feb. 1604 they feloniously stole, took and carried away eight cheeses to the value of two shillings from Robert Swayne at Leverington. Whiteakers not guilty of first indictment; guilty of second indictment, allowed benefit of clergy. Orvye did not appear in court.

[49] William Haynes of Whittlesey, [occupation not stated], answered Roger Wyseman in an action of trespass on the case that on [date not stated] he slandered Wyseman by publicly proclaiming that Wyseman robbed a trunk of fish from a certain Thomas Guerille. Barret acquitted; Jetherell fined for bringing a false claim.

[99] William Abbot, Joseph Papworth, Tobias Hudson and John Round, [occupation and place of abode not stated], are summoned to answer Robert [Nurse] in an action of theft that on 11 Nov. 1603 they took a gelding from [Nurse] from a place called Hollwood at Chatteris. The defendants are fined; to pay damages.
  42. 21r. [100] John Hartly of Terrington St John, Norfolk, weaver, answered Thomas Champyon in an action of trespass on the case relating to payment for the dressing and dyeing of [seven] woollen cloths, 31 July 1603 at Wisbech. To proceed to jury trial.
  43. 21r. [101] Robert Hawkyns of Chatteris, cordwainer, answered John Betts, gentleman, in an action of trespass that on 3 Aug. 1603 he entered the close and house of Betts in Chatteris. Pled not guilty; to proceed to jury trial.
  44. 21r. [102] John Richars, alias Glover, of Terrington, Norfolk, yeoman, and Robert Farthinge of Walpole, Norfolk, yeoman, are fined and are to pay damages in relation to an action of debt brought by [Wimondo] Cary against Robert Wherewas, first heard before John Spurling esquire, chief Justice, on 12 Aug. 1600 at Wisbech.
  45. 21v. [103] Jeremiah Syms, [place of abode and occupation not stated], is summoned to answer John Heyward in an action of theft that on 8 Apr. 1604 he took a cow from Heyward at Littleport. Heyward fined for bringing a false claim.
