Ely, 21 Mar. 36 Eliz. [1594]: Pleas and gaol delivery before Spurling and others. Preamble: letters patent; writ of assizes; gaol delivery commission.

  1. 1r. John Hamond of Ely, baker, and William Grene of Ely, joiner, are indicted that on 4 Mar. 1591 they feloniously burgled the dwelling house of Richard Lawrence of Ely at about the hour of 11pm, assaulted Lawrence and took and carried away 18 pounds in numbered money, [?] to the value of 8 shillings and a pewter pot to the value of six pence. Hamond not guilty.
  2. 1v. Thomasine [or Tamsin] Woode of Ely, widow, is indicted that on 19 Oct. 1593 she feloniously took and carried away three yards and a half of woollen cloth to the value of seven shillings and a quarter of a yard of velure [velvet] from Thomas Gimmell at Ely. Not guilty.
  3. 1v. Esther Hebblethwayte, spinster and wife of John Hebblethwayte of Wisbech, shoemaker, is indicted that on 18 Dec. 1593 she feloniously assaulted and murdered John Hebblethwayte with a pair of tongs causing him to languish and die. Guilty; pled pregnancy, to be remanded in gaol.

Thomas Bywaters of Whittlesey, yeoman, and Gilbert Clarke of March, weaver, are indicted that on 26 Feb. 1594 they assaulted William Phillip and Christopher Marche, who were travelling by boat on Whittlesey Dyke, and took three pounds in numbered money belonging to a certain Thomas Blapthorne from the person of William Phillip. To be remanded in gaol.
  5. 2r. John Robynson of Manea, labourer, is indicted that on 24 Dec. 1593 he feloniously took and drove a white wether [castrated ram] from an unknown person at Manea. Confessed; to be whipped.
  6. 2r. John Angood of Downham, labourer, is indicted that on 25 Dec. 1593 he feloniously took and carried away a bushel of wheat worth nine pence and a bag worth two pence from Lawrence Johnson at Downham. Guilty; to be whipped.
  7. 2r. Christopher Elmer of Downham, labourer, Hercules Bates of Downham, weaver, Thomas Nix of Downham, yeoman, [Romanus] Turner of Ely, baker, John Robyns of Manea, labourer, and Anne Hansley, wife of Richard Hansley of Leverington, labourer, are freed and acquitted.
  8. 3v. William Gunton of Sutton, husbandman, and Robert Hallyday of Sutton, glover, are summoned to answer Richard Pedley in an action of animal theft that on 15 May 1593 at a place called Little Hollode at Westren in Sutton he took 18 steers and 13 Herefords from Pedley. There is discussion over ownership of the land. To proceed to jury trial.
  9. 3v. Lancelot Flower of Ely, gentleman, is summoned to answer Nicholas Messey, gentleman, in an action of animal theft that on 26 Nov. 1593 at a place called Whatoole Croft he took six pigs from Messey. Flower to pay damages.

Francis Coker of Haddenham, waterman, answered Arthur Gallyon in an action of trespass that, with William Chawner of Haddenham, weaver, and Robert Coker of Haddenham, basket maker, on 23 May 1591 their livestock trampled and overgrazed the grass growing in the close of Gallyon at Aldreth in the parish of Haddenham causing damage. Pled not guilty; to proceed to jury trial.

Richard Mann of Upwell, yeoman, answered John Elveston and Margaret White, his wife, in an action of trespass on the case and breach of promise relating to Margaret’s possession of a long framed table, a table with leaves and another table, a cupboard, a bench mat with two planks, a great plank, two little stools, a brass pot, a hanging shelf, a ladder, three hurdles, a wooden window and [? a mealebyng] to the value of 100 shillings, 30 Nov. 1591 at Upwell. Pled not guilty; to proceed to jury trial.
  12. 4r. Robert Chawner of Downham, husbandman, answered Nicholas Gunton in an action of trespass that on 20 July 1591 he mowed and took away grass growing in the close of Gunton at Downham to the value of 40 shillings. Pled not guilty; to proceed to jury trial.
  13. 4v. Thomas Day of Littleport, husbandman, answered John Crabb in an action of trespass that on 10 Aug. 1593 he took and carried away barley to the value of 40 shillings from Crabb’s close at Littleport. Pled not guilty; to proceed to jury trial.
  14. 4v. William Jyner of Downham, Norfolk, mercer, is summoned to answer Thomas Gilley in an action of debt that on 1 July 1588 he was a receiver of four pounds and ten shillings from John Tormingham.
  15. 4v. James Jobson of Outwell, Norfolk, gentleman, answered John Howard in an action of trespass on the case that on 20 Jan. 1594 he publicly slandered Howard, accusing of him of stealing his horse and threatening to raise the hue and cry. Pled not guilty; to proceed to jury trial.
  16. 5r. George Brady of March, gentleman, alias George Brady of Fen Ditton, gentleman, is summoned to answer Richard Pedley in an action of debt of three pounds relating to a bond of obligation of 29 Oct. 1593 at March. To proceed to jury trial.
  17. 5r. Robert Morgan of Ely, glover, is summoned to answer Geoffrey Rowles, executor of the will of Thomas Rowles, in an action of debt of 20 pounds relating to a chest and 20 pounds belonging to Thomas Rowles, 4 Mar. 1577 at Ely. Pled not guilty; to proceed to jury trial.

John Coles of Littleport, husbandman, Joseph Coles of Littleport, labourer, and John Mobb [junior] of Littleport, labourer, answered William Wylson in an action of trespass that on 24 Aug. 1593 took and carried away three cart-loads of peas from Wylson at Littleport.   19. 5v. Robert Mathewe of Elm, gentleman, answered Francis Archer in an action of trespass on the case that he publicly slandered Archer as a murderer who had murdered a man most shamefully. Mathewe to pay costs and damages at the next session. The date and place of the slander is not given.
  20. 6r. John Tawyer of Thetford, labourer, and Hugh Tawyer of Thetford, labourer, answered Thomas Blake, gentleman, in an action of trespass that on 1 Sept. 1593 he mowed grass growing in the close of Blake at Thetford to the value of 40 shillings. John and Hugo arrested; to pay damages.
  21. 6r. William Buck of Salesland [?Seal’s Island], Norfolk, waterman, is summoned to answer Francis Reipps, gentleman, in an action of debt of six pounds relating to a bond of obligation of 8 July 1590 at Wisbech. Buck to pay damages.
  22. 6r. Lancelot Whatcole, alias Flower, [place of abode and occupation not stated], is summoned to answer Nicholas Messey, gentleman, in an action of animal theft that on 15 Jan. 1594 he took seven pigs from Messey at a place called Whatcoles Croft at Ely. Flower arrested; to pay damages.
  23. 6v. William Yeoman of Tydd St Giles, labourer, answered Robert Glynn in an action of trespass on the case and breach of promise relating to Broad Drove in Tydd St Giles and the exchange of nine nets and a boat. Yeoman to pay costs and damages at the next session.

Lancelot Flower, [place of abode and occupation not stated], is summoned to answer Nicholas Messey, gentleman, in an action of animal theft that on 3 Dec. 1593 he took [an unidentified] number of pigs from Messey at a place called Whatcoles Croft at Ely. Messey adjudged to have sustained damages.
  25. 7r. Bridget Fletcher, widow and administrator of the goods and chattels of William Fletcher, late of Wisbech, vintner, who died intestate, is summoned to answer William Palmer in an action of debt of 30 pounds relating to a bond of obligation of 30 Sept. 1590 at Wisbech. Fletcher is fined.
  26. 7v. Richard Mann of Upwell, yeoman, answered John Elveston and Margaret, his wife, in an action of trespass that on 10 Mar. 1592 he entered the close and house of John and Margaret and forced them out. There is discussion over the ownership of the close and house, and various other parts of land. Mann arrested; to pay damages.

  1. 9r. [27] Gilbert Greene of Sutton, labourer, is indicted that on 19 Apr. 1594 between the hours of 8 and 11 at night he feloniously burgled the dwelling house of John Rashe at Sutton and took and carried away 20 pounds in numbered money. Not guilty.
  2. 9v. [28] John Ansell of Sutton, tailor, is indicted that on 24 Oct. 1593 he assaulted and feloniously murdered Thomas Upthiere, gentleman, with a rugged iron sword at Ely. Guilty; to be hanged.
  3. 9v. [29] Mary Maister of March, spinster, is indicted that on 8 May 1594, being pregnant and having given before to a living female child, feloniously killed the child by suffocating it with a packthread. Guilty; to be hanged.
  4. 9v. [30] William Yonge of Doddington, labourer, is indicted that on 8 May 1594 he feloniously took and drove four steers (one coloured brown worth 40 shillings, two coloured red worth 40 shillings each and one coloured brown worth 30 shillings) from Thomas Wells at Doddington. Guilty; to be hanged.
  5. 9v. [31] Oliver Stonhowse of Wisbech, labourer, is indicted that on 11 May 1594 he feloniously took and led away a grey gelding worth three pounds and 30 shillings from William Waring at Wisbech. Guilty; to be hanged.
  6. 10r. [32] William Bell of Wisbech, labourer, is indicted that on 25 May 1594 he feloniously took and drove 11[?rams] worth four pounds from Richard Catterton and on the same day five [?rams] from James Catterton at Wisbech. Guilty; to be hanged.
  7. 10r. [33] John Deacon of Whittlesey, labourer, Robert Field of Ely, labourer, Nicholas Shyner of Wisbech, husbandman, Agnes Hodson of Ely, spinster, Henry Shoner of Wisbech, labourer, Thomas Bayly of Witchford, labourer, and Nicholas Roberts of Ely, labourer, are freed and acquitted.
  8. 10r. [34] Thomas Ladyman of Haddenham, wheelwright, is indicted that on 6 Sept. 1593 he publicly slandered the Queen [Elizabeth I] saying ‘I care not for the Queen, she is not worthy to wear the Crown nor her counsellors that be about her are not worthy to give her any counsel.’ The entry is incomplete; no outcome is stated.
  9. 11r. [35] William Fenner and Anne, his wife, [place of abode not stated] are summoned to answer John Hatcher esquire in an action relating to a share of various holdings of land in Wisbech and Elm which Thomas Reade, gentleman, the father of Anne and grandfather of John Hatcher (that is the father of Katherine Hatcher, John’s mother). No date is stated. To proceed to the next session.
  10. 11v. [36] Oliver Browne of Mepal, husbandman, answered William Mynot in an action of trespass of the case that on 30 May 1592 he did not permit Mynot to take his cart down a road or highway which led from Coteway to Whidden. Pled not guilty; to proceed to the next session.
  11. 11v. [37] Richard Hatche of Stretham, husbandman, answered William Hatche in an action of trespass that on 3 Feb. 1594 he broke and entered the close and house of William Hatche called Hitches House at Stretham. Pled not guilty; to proceed to the next session.
  12. 11v. [38] Arthur Heynes of Whittlesey, husbandman, is summoned to answer Ralph Crabbe in an action of debt of 40 shillings which he borrowed from Crabbe on 10 Apr. 1594 at Whittlesey. Heynes is fined.
  13. 12r. [39] George Blaxton of Ely, tailor, answered David Ayer in an action of trespass on the case and breach of promise relating to a large number of household goods and furniture, 1 Mar. 1594. Pled not guilty; to proceed to the next session.

The defendants counter that it was Bugg who assaulted Upchiere. To proceed to jury trial.

[45] John Wilson of Ely, husbandman, answered John Tompson in an action of trespass that on 4 Oct. 1593 he assaulted William Miller, then the servant of John Tompson, and took and drove a hog worth ten shillings and six hares worth 30 shillings from Tompson at Ely. Wilson counters the animals were taken by Daniel Large, William Symonds and John Harvye. To proceed to jury trial.
  20. 14r. [46] Thomas Nince of Ely, cleric, is summoned to answer Humphrey Tyndall, Dean of Ely Cathedral, in an action of theft that on 28 Dec. 1592 he took a stone trough from the Cathedral. There is discussion over the burial of the unnamed wife of William Adams esquire. Tyndall requests inquiry.
  21. 14r. [47] John Adams of Leverington, tailor, is summoned to answer Anthony Fisher in an action of debt of 100 shillings relating to a bond of obligation of 10 Jan. 1594 at Wisbech. Adams is fined.

  1. 15r. [49] Henry Stayre of Ely, weaver, is indicted that on 18 June 1593 he feloniously took and carried away two shillings in numbered money, a neckerchief worth ten pence and a coverlet worth three shillings and six pence from John Smyth at Ely. Not guilty.
  2. 15v. [50] Andrew Sandford of Ely, shoemaker, is indicted that on 28 Feb. 1593 he feloniously took and carried away a firkin of butter to the value of eight shillings from Henry Rap at Ely. Not guilty.
  3. 15v. [51] Henry Atashe of Littleport, weaver, is indicted that on 28 Feb. 1593 he feloniously took and carried away a sley [an instrument used in weaving to beat up the weft] to the value of two shillings from William Pearson at Littleport. Not guilty.

[52] Ralph Searle of Whittlesey, labourer, is indicted that on 6 Sept. 1592 he feloniously took and drove a steer coloured red worth 30 shillings from Edward Garnett at Whittlesey and on the same day three heifers (two coloured black worth five pounds and one coloured black brown worth 40 shillings) from John Danbbye. He is further indicted on 15 Mar. 1593 he feloniously took and drove three ewes and one lamb from John Gakyns. Guilty; allowed benefit of clergy.

  1. 22r. [76] Isaac Kynge of Downham, labourer, is indicted that on 18 Dec. 1592 he feloniously took and carried away a coverlet to the value of 16 shillings, a sheet to the value of four shillings and a table-napkin to the value of 12 pence from John Ansell at Downham. Not guilty.
  2. 22r. [77] Elizabeth Tyllngham of Ely, widow, is indicted that on 14 Jan. 1593 she used, exercised and practiced enchantments, witchcraft and magical arts on John Smyth of Ely causing him to languish and die. Not guilty.
  3. 22v. [78] Richard Guy of Ely, cutler, and William Hynde of Littleport, weaver, are indicted that on 13 Jan. 1593 they feloniously took and carried away a rooster and ten hens worth two shillings from Richard Banke at Ely. Hynde is indicted that on the same day he feloniously took and carried away two sheets to the value of two shillings and a linen smock to the value of six pence from Edward Atkyn at Eky. Guilty; allowed benefit of clergy.

[83] Joan Pulter, widow and administrator of the goods and chattels of Henry Pulter lately of Wisbech, gentleman, who died intestate, answered Arthur Dalton in an action of trespass on the case and breach of promise relating to the sale of various quantities of broad stamell cloth, 23 May 1590 at Wisbech. To proceed to jury trial.

[84] Joan Pulter, widow and administrator of the goods and chattels of Henry Pulter lately of Wisbech, gentleman, who died intestate, answered Arthur Dalton in an action of trespass on the case relating to a debt of 40 shillings owed by Catherine Norman, widow, to Pulter, 1 Aug. 1591 at Wisbech.   12. 25r. [87] William Carter of Ely, fisherman, answered William Auger in an action of trespass that on 15 Nov. 1592 he drove away a sow belonging to Auger with dogs. Pled not guilty; to proceed to jury trial.
  13. 25v. [88] Margaret Auger of Ely, widow, and William Auger of Ely, husbandman, answered William Carter in an action of trespass that on 25 Oct. 1593 their livestock ate, trampled and spoiled the crops growing there, namely carrots, roots and parsnips, causing damage. Pled not guilty; to proceed to jury trial.
  14. 25v. [89] Henry Sayer of Ely, weaver, is summoned to answer John Hutton in an action of debt of three pounds relating to a bond of obligation of 28 Aug. 1590 at Ely. Pled not guilty; to proceed to jury trial.

[90] Thomas Jetherell, gentleman, [place of abode not stated], is summoned to answer Thomas Lyllie in an action of animal theft that on 24 Nov. 1591 he took 37 sheep [ewes] from Lyllie at a place called Berry Fold at Sutton. There is discussion of another piece of land in Sutton. Pled not guilty; to proceed to jury trial.

[91] Thomas Jetherell, gentleman, [place of abode not stated], is summoned to answer Edward Upcher, gentleman, in an action of animal theft that on 24 Nov. 1591 he took 30 sheep [ewes] from Upcher at a place called Berry Fold at Sutton. There is discussion of another piece of land in Sutton. Pled not guilty; to proceed to jury trial.
  17. 26r. [92] Robert Tubbes of Wentford [Wentworth], yeoman, answered Nicholas Kyrkes in an action of trespass that on 25 July 1592 he entered Kyrkes’ close at Wentford called Busshe Close, and mowed and carried away grass growing there. Tubbes to pay damages.
  18. 26v. [93] Jane Spencer of Emneth, Norfolk, widow and administrator of the goods and chattels of Robert Spencer late of Emneth, husbandman, who died intestate, answered William Busshoppe in an action of debt of 60 shillings relating to a bond of obligation of 8 Oct. 1592 at Wisbech. Spencer arrested; to pay damages.
  19. 26v. [94] George Thornton renounced his suit in an action of trespass on the case against Francis Fage of March.
  20. 26v. [95] Edward Annbry and Agnes, his wife and executor of the will of James Shepperd, renounced their suit in an action of trespass on the case against Richard Whittered of Tydd St Giles, labourer.
  21. 26v. [96] Robert Turne, alias Turner, of Whittlesey, husbandan, answered William Richardson in an action of trespass that on 5 Aug. 1593 he assaulted Richardson with arms, and took and carried away ten cart-loads of hay. Pled not guilty; to proceed to jury trial.
  22. 27r. [97] Robert Umwell of Wisbech, [occupation not stated], answered Robert Mathew in an action of trespass on the case and breach of promise relating to 11 kilderkins of beer, 20 Aug. 1592 at Wisbech. Pled not guilty; to proceed to jury trial.
  23. 27r. [98] Thomas Clarke of Littleport, husbandman, answered Margaret Lambe, widow, in an action of trespass on the case relating to a debt of three pounds owed by Clarke and William Lambe to Margaret, 26 Jan. 1593 at Littleport. Pled not guilty; to proceed to jury trial.
