Preamble: letters patent, writ of assizes and gaol delivery commission.

Membrane 1v.

1. Henry Rayner of Outwell, labourer, is indicted that on 9 Oct. 1585 at Outwell he feloniously took and drove off a brown bull worth 40 shillings from John Watson and on the same day he feloniously took and drove off a black brown bull worth three pounds from Nicholas Garner. Not guilty.

2. Henry Parryter of Ely, labourer, and John Goodyn of Ely, labourer, are indicted that on 28 Dec. 1585 they feloniously took and carried away a bushel of apples from Ed[ward] Fyson at Ely. Not guilty.

3. Robert Cortyer of Wisbech, labourer, and Henry Freer of Wisbech, labourer, William [Gliner] of Whittlesey, labourer, and Margaret, his wife, are indicted that on 25 Dec. 1585 Cortyer broke and entered the milk house of Thomas Whyte at Guyhirn and feloniously took and carried away 12 stone of cheese to the value of 20 shillings, a linen sheet to the value of 20 pence, an apron to the value of four pence and a table napkin to the value of four pence. Freer and Gliner are indicted that on 27 Dec. 1585 they feloniously received and gave comfort to Cortyer at Wisbech. Cortyer guilty; allowed benefit of clergy. Freer and Gliner not guilty.

3. Thomas Seekes of Wisbech, labourer, is indicted that on 1 Feb. 1586 he broke and entered the mansion house of Hugh Bradshawe at Wisbech and feloniously took and carried away a doublet to the value of three shillings and a pair of shoes or boots worth 20 shillings. Guilty; allowed benefit of clergy.

4. Edward Tayler of Ely, shoemaker, Barnabas Jenkyns of Ely, yeoman, Robert Smyth of Ely, butcher, John Bentley of Tydd St Giles, labourer, John Rogers of Outwell, husbandman, Robert Butler of Ely, labourer, and Joan Foster of Littleport, spinster, are freed and acquitted.

6. Thomas Stevenson of Downham, carpenter, is indicted that on 17 June 1585 at Churcham in the parish of Ely [Chettisham] he broke and entered the close of John Fowler and feloniously took and drove off a brown cow worth 30 shillings. Guilty; allowed benefit of clergy.

7. John Waller of Well, labourer, is indicted that on 20 May 1585 he broke and entered the close of Henry Johnson at Well and feloniously took and carried away six chickens worth eight pence and a fork to the value of two pence. Guilty; no goods or property to forfeit.

8. Thomas Oryner of Ely, brickmaker, is indicted that on 20 June 1585 at Ely he broke and entered the mansion house of William Jorden and feloniously took and carried away a shirt to the value of eight pence and a handkerchief to the value of two pence. Not guilty.

9. Edward Tompson of Wisbech, labourer, John Yonge of Wisbech, labourer, Richard Ripton of Wisbech [occupation not stated] and Elizabeth Irelande of Wisbech, spinster, are indicted as vagrants with no land, no master and no legitimate trade on 1 Aug. 1585 contrary to statute [Vagrancy Act 1572, 14 Eliz. I. c.5]. To be burned through the cartilage of the right ear with a hot iron and then whipped.

10. William Wright of Wisbech, labourer, is indicted that on 1 Aug. 1585 for fourteen years and longer he has been a vagrant with no land, no master and no legitimate trade contrary to statute [Vagrancy Act 1572, 14 Eliz. I. c.5]. John Lane of West Walton, Norfolk, gentleman, is to take Wright into service for a period of two years.

11. Stephen May of Walsoken, Norfolk, and Avery Coo of Ely, labourer, are freed and acquitted.

12. John Lane of West Walton, Norfolk, is bound to take William Wright, vagrant, into his service for two years under financial penalty.

13. George Homes of Tilney, Norfolk, husbandman, is bound to answer Humphrey Harryson in a plea of trespass on the case. John Storye of Wisbech, draper, and James Salowbanke of Wisbech, yeoman, act as surety.

14. Thomas Porter of Westminster, Middlesex, gentleman, is bound to answer John Peepis in a plea of debt. Thomas Robynson of Wisbech, yeoman, and Robert Palmer of Wisbech, brewer, act as surety.

15. James Cryspe of Wisbech, gentleman, is bound to answer Thomas Carter in a plea of trespass on the case. James Hubberd of Wisbech, gentleman, and John Cole of Wisbech, yeoman, act as surety.

16. John Pepis of Cottenham, gentleman, is bound to answer Thomas Porter in a plea of trespass on the case. James Cryspe of Wisbech, gentleman, acts as surety.

17. Thomas Jones of Leverington answered Thomas Whycke in a plea of trespass and ejection that on 9 July 1585 he forcibly ejected Whycke from a messuage in Leverington which he had leased from Thomas Robynson. Jones pled not guilty; to proceed to jury trial.

18. George Wallys of Whittlesey, gentleman, answered Simon Worliche, gentleman, in a plea of ejection that on 26 Mar. 1585 he forcibly ejected Worliche from a messuage which Worliche leased from William Cony, gentleman, for a term which had not yet expired. To proceed to jury trial.

19. John Hynson of Whittlesey, labourer, answered William Malyn in a plea of trespass and ejection that on 23 Mar. 1585 he forcibly ejected Malyn from a holding which Malyn leased from Francis Redman and Helen, his wife, for a term which had not yet expired. The court rules against William Malyn; Hynson is discharged.

20. James Spencer of Tydd St Giles, labourer, answered Francis Shaxton, gentleman, and Etheldred, his wife, in a plea of trespass that on 8 May 1585 he broke and entered the close of the Shaxtons in Tydd St Giles comprising nine acres of pasture in a field called Kelatt Field and dug up and spoiled the pasture. Spencer pled not guilty; to proceed to jury trial.

21. James Cryspe of Wisbech, gentleman, answered Thomas Porter, gentleman, in a plea of trespass on the case relating to the promise of James and Anne, his wife and late wife and executor of Thomas Orrell deceased, to board Lewis Orrell. To proceed to jury trial.

22. George Tynby of Leverington, husbandman, answered Thomas Dorman in a plea of trespass that on 17 July 1585 he forcibly broke and entered the close of Dorman at Wisbech St Mary, namely six acres of land and pasture lying in Seiresfield [Sayer’s Field], and overgrazed the grass growing there with his livestock. Tynby pled not guilty; to proceed to jury trial.

23. Avery Coo of Ely, labourer, answered John Hawes in a plea that on 20 Sept. 1585 he forcibly broke and entered Hawes’s close at Ely and ploughed one acre of land. Coo pled not guilty; to proceed to jury trial.

24. Robert Aunger of Ely, yeoman, answered John Hawes, gentleman, in a plea of trespass that on 15 June 1585 he broke and entered the close and toft of Hawes at Ely lying in a place called Downham Street and killed a pig worth six shillings and eight pence. Aunger pled not guilty; to proceed to jury trial.

25. William Pottall of Aldreth, yeoman, answered John Kyrke in a plea of non-payment of 100 shillings which Pottall borrowed on 26 July 1584 at Aldreth. Pottall says that he sold Kyrke three heifers, one bull and one horse in consideration of the 100 shillings. To proceed to jury trial.

26. Thomas Badgecrofte [place of abode and occupation not given] answered John Watten in a plea of trespass on the case relating to a half-share of a messuage and three acres of land lying in Downham Market, Norfolk, 20 Aug. 1582. To proceed to jury trial.

27. Thomas Jervys of Ely, gentleman, answered Thomas Flower, gentleman, in a plea that on 31 July 1584 he assaulted, wounded, beat and maltreated Flower at Ely. To proceed to jury trial.

28. William Coker of Tydd St Giles, husbandman, answered John Whittered in a plea of trespass that on 20 July 1585 he forcibly entered Whittered’s close at Tydd St Giles, consisting of six acres of marsh, and overgrazed and depastured the grass there with his livestock. Coker pled not guilty; to proceed to jury trial.

29. William Pottall of Woodhurst, Huntingdonshire, answered John Gooday in a plea of trespass on the case relating to a dispute over the lease of a messuage and 60 acres of land in Haddenham. To proceed to jury trial.

30. John Bucke of Thetford, yeoman, answered John Thornton, gentleman, in a plea of non-payment of six pounds relating to the lease of a messuage, 20 acres of land and 40 acres of pasture with appurtenances in Thetford. To proceed to jury trial.

William Rochell [place of abode and occupation not given] answers Richard Parkynson in a plea of trespass that on 30 July 1584 at Whittlesey he took and led away certain animals from an enclosed piece of land, namely 23 acres of pasture called [Blemust]. Rochell pled not guilty; to proceed to jury trial.

32. Arthur Edwards of Tydd St Giles, yeoman, answered Francis Shaxton, gentleman, and Ethelred [or Audrey], his wife, in a plea of trespass that on 8 May 1585 he forcibly entered their close at Tydd St Giles called nine pastures lying in Gelett Field and overgrazed and depastured the grass there with his cattle. Edwards pled not guilty; to proceed to jury trial.

33. John Chrystyan of Coveney, cleric, answered Henry Chrystian in a plea of trespass on the case that relating to the ministry of the parish church of Coveney on 17 Apr. 1584. To proceed to jury trial.

34. George Homes of Tilney, Norfolk, husbandman, answered Humphrey Harryson in a plea of trespass on the case that on 1 July 1585 he did, in scandalous words, accuse Harryson of stealing a ram from him. To proceed to jury trial.

35. William Gooday senior of Haddenham, yeoman, answered Cuthbert Browne in a plea of non-payment of 40 pounds relating to a bond of obligation and arbitration award made 4 Jan. 1578 at Ely. The bond of obligation is recited. To proceed to jury trial.

36. Robert Gybon of Littleport, gentleman, answered John Davy esquire relating to a dispute over the ownership of two heiffers, one worth 46 shillings and eight pence and one worth 33 shillings and four pence, which Davy took possession of on 20 July 1583 at Littleport. To proceed to jury trial.

37. Andrew Glosyer [place of abode and occupation not given] answered John Everard in a plea that on 12 Nov. 1584 at Downham at a place called the North Fenn he took a cow from Everard. Glosyer accuses Everard of obstruction and hinderance. To proceed to jury trial.

38. William Dove of Downham, yeoman, answered William Bartropp in a plea of trespass that on 20 Dec. 1585 he ploughed one acre of land belonging to Bartropp in Donwham lying in a field called Hawkeley Field. Dove pled not guilty; to proceed to jury trial.

39. Samuel Walker of Wentworth, husbandman, answered Cuthbert Brown in a plea of trespass and ejection that on 4 Oct. 1585 at Wentworth with swords, clubs and daggers he forcibly ejected Brown from a messuage, three acres of land and a windmill which Brown had leased from Alice Pate for a term which had not yet expired.

40. William Grene of Walsoken, Norfolk, husbandman, answered William Cawson in a plea of trespass on the case that on 27 Jan. 1585 at Wisbech he did, in scandalous words, accuse Caswon of being a knave who encroached other men’s land and lived off other men’s goods. Pled not guilty; to proceed to jury trial.

41. Daniel Bradshawe of Ely, baker, and Robert Johnson of Ely, baker, answered Charles Clarke in a plea of trespass that on 20 Feb. 1585 they broke and entered Clarke’s close at Ely and took and led away a horse worth 15 marks. Bradshawe pled not guilty; to proceed to jury trial.

42. John Hawes of Ely, gentleman, and Agnes Sloe of Ely, spinser, answered Michael Aunger in a plea of trespass that on 30 Apr. 1585 they broke and entered Aunger’s close at Ely called a bullock yard and took and carried away timber to the value of 40 shillings and their cattle also caused damage to the hemp growing there. The ownership of a messuage and garden in Ely is discussed at length. To proceed to the next session.

43. Michael Aunger of Ely, gentleman, answered John Hawes of Ely, gentleman, in a plea that on 6 June 1585 at Ely with force and arms he and John Pierson of Ely, yeoman, assaulted, imprisoned and detained Hawes. There is discussion of an earlier case of trespass [see EDR E1/6/5, entry 25].

44. Robert Allabye of Ely, husbandman, answers Leonard Taylor of Cambridge, cordwainer, in a plea of non-payment of four pounds relating to a bond of obligation, 23 Jan. 1585 at Ely. Allabye is fined.
